Indigenous peoples and other traditional communities have long argued that their traditions, knowledge systems and cultures are under threat from a variety of sources, such as new technologies and the globalization of culture and commerce. It is also argued by some that their traditional knowledge systems and cultural expressions are not adequately protected by or against current intellectual property (IP) laws. In this regard, the World Intellectual Property Organization (WIPO) is engaged in a program of work examining the interfaces and relationships between IP laws and the protection of Indigenous and traditional forms of creativity and innovation.

Fifth Session Geneva, July 7 to 15, 2003 by Maria Thereza Wolff The Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (“the Committee”) has agreed on the development of a toolkit to provide practical assistance to TK holders and custodians of genetic resources who are faced with this challenge.
